In an action to recover damages for personal injuries, the defendant City of New York appeals, as limited by its brief, from so much of (1) an order of the Supreme Court, Queens County (Flug, J.), dated August 14, 2002, as denied that branch of the motion of the defendant City of New York which was for summary judgment dismissing the complaint insofar as asserted against it, and (2) an order of the same court dated April 8, 2003, as upon, in effect, granting its motion for leave to renew, adhered to the prior determination.
