LIGHTFOOT, Chief Justice.

This suit was brought by appellee to recover damages for personal injuries received by him while riding as a passenger on defendant’s train at Lansing Switch, January 31, 1888. Plaintiff was an employe of defendant in the capacity of fireman on a locomotive, with headquarters at Longview, but at the time of the injury was not on duty, and was riding as a passenger on a pass from Longview to another station on defendant’s road, and was riding on the engine by permission of the engineer.
