The material facts out of which this controversy arises are these: Miles B. Branch died, in 1861, seized of a tract *364•of 787 3-4 acres of land in Brunswick county. By his will, which was probated in October, 1861, he gave his wife one-third of his estate for life, and subject to this life estate he devised the land to his four daughters — Ann R. Green, Rosa M. Branch, Susan E. Branch and Mary E. Branch. George W. Green, who was the husband of his daughter, Ann R. Green, was named as executor and qualified.
