Judge MARQUEZ.

Frederick R. Lamutt (husband) appeals a judgment finding him in contempt for nonpayment of child support. The primary issue in this appeal is whether husband or Michelle A. Lamutt (wife) has the burden of proof in a contempt proceeding. Inasmuch as we conclude that there was no error in the allocation of the burden of proof, we affirm.

The marriage of the parties was dissolved by a decree entered in 1985 approving the parties’ separation agreement in which they agreed to “live separate and apart ... without direction, control, or molestation from the other ... and…
