The judgment rendered in this case on the 5th of January last (see opinion, 112 U. S. 696) was set' aside on the last day of the last term, and the cause was restored to the docket for reargriment at the present term. The original action was-brought by several joint plaintiffs,, minors and children of Samuel H. Pendleton, deceased, against the Knickerbocker Life Insuranpe Company, on a policy of insurance on the life of said Samuel, taken out by him for the benefit of his said children; and judgment was rendered for the plaintiffs, some of whom had, in the mean time, come of age.
