At the October, 1925, term of the circuit court of Macon county the grand jury returned an indictment charging that on the second Monday of August, 1925, an information was filed in the county court of Macon county by the State’s attorney of that county, alleging that plaintiff in error on the third day of August of that year certain intoxicating liquor unlawfully did then and there possess, said intoxicating liquor having been unlawfully acquired by him; that said intoxicating liquor contained more than one-half of one per cent of alcohol by volume; that it was fit for beverage purposes;…
