Brannon, Judge:

At the general election in November, 1898, the voters of Randolph County voted upon the question of the removal of its county seat from Beverly to Elkins, and when the commissioners of the county court met as a board of canvassers to canvass the returns of the election for Governor and other officers, C. H. Scott, John T. Davis, and W. G. Wilson,, voters and taxpayers of the county, appeared before that board, and moved it to take up the certificates sent from the voting precincts as the vote upon the question, and declare the result; and T.
