The defendant in error-was indicted for an assault and battery on Ida Klube. He was convicted by the Onondaga Court of Sessions, and sentenced to imprisonment for one year and a fine of $250. At the time of the trial another indictment was pending in the Court of Oyer and Terminer, charging him with the same transaction as a rape. The accused was a haekman in Syracuse.
