Plaintiff Evelyn L. Middleton, pro se , has sued the U.S. Department of Labor ("DOL") alleging negligence and breach of fiduciary duties under the Employee Retirement Income Security Act ("ERISA") and the Federal Tort Claims Act ("FTCA").
