HENDERSON, Judge.

Appellant was convicted of murder in the first degree and his punishment assessed at life imprisonment in the penitentiary, and he prosecutes this appeal. The case against the defendant is one of circumstantial evidence and the evidence tends to show that deceased, Earl Dockery, was a young man some 18 or 19 years of age and late in the evening of the 4th of October, 1906, he was found near the Bock Island railroad track in the suburbs of Amarillo in a dying condition: He was stripped naked and had evidently been placed there by someone during the previous night; and a number…
