Plaintiffs have petitioned for a rehearing. It is asserted in the petition that this Court overlooked the decision in Hedderich v. Hedderich, 18 N.D. 488, 123 N.W. 276, wherein it was said that an appeal from the judgment presents to the Supreme Court alleged errors of law occurring at the trial as preserved in the judgment roll although such errors were also urged as grounds, .for a new trial in the court below and the order denying such new trial was not appealed from.
