I concur in the result reached in the principal opinion except as it relates to the issue of whether a submissible case was made against IMCO Recycling, Inc. (“IMCO Recycling”). I believe that it was not, and respectfully dissent from that portion of the opinion holding otherwise.

Prior to October 1, 1995, Pittsburg Aluminum, Inc. (“Pittsburg”) and Marnor Aluminum Processing, Inc. (“Marnor”) were wholly owned subsidiaries of Metal Mark, Inc. (“Metal Mark”) which was, in turn, a wholly owned subsidiary of Alumar, Inc. (“Alumar”). On that date Alumar merged with IMCO Recycling of Illinois, Inc.…
