On December 15, 2011, plaintiff U.S. Securities and Exchange Commission (“SEC”) filed a purported appeal from this *337Court’s Opinion and Order rejecting the parties’ proposed Consent Judgment. See SEC v. Citigroup Global Mkts., 827 F.Supp.2d 328, 330, 2011 WL 5903733, at *2 (S.D.N.Y. Nov. 28, 2011) (the “November 28 Decision”). Defendant Citigroup Global Markets Inc.
