ORDER
SUSAN WEBBER WRIGHT, District Judge.
The Court has received the report and recommendation for entry of summary judgment pursuant to 28 U.S.C. § 157(c)(1) from United States Bankruptcy Judge Mary Davies Scott. After careful review of the report and recommendation, the Court concludes that the recommendation should be, and hereby is, approved and adopted. Defen dant’s motion for summary judgment is granted and the cause is dismissed. The cross-motion of plaintiff is denied. Judgment shall be entered accordingly.
