On June 26, 1995, appellants, Leonard Copeland, Franklin Adkins and Alfred L. Miller, filed a complaint in the Franklin County Court of Common Pleas seeking a judgment declaring the additional permissive sales and use taxes levied on retail sales and the storage, use and consumption of motor vehicles and other tangible personal property in Morrow County, which was approved by voters in a special election held May 2, 1995, illegal, void and of no effect.
