*1416Appeal from a judgment of the Supreme Court, Erie County (Russell E Buscaglia, A.J.), rendered June 10, 2008. The judgment convicted defendant, upon a nonjury verdict, of criminal possession of stolen property in the fifth degree and criminal possession of a controlled substance in the seventh degree.

It is hereby ordered that the judgment so appealed from is unanimously affirmed.
