Nebraska Advance Sheets 32 290 NEBRASKA REPORTS VI. CONCLUSION We find no merit to Sellers’ assigned errors. His assertions of ineffective assistance of trial and appellate counsel failed to establish any prejudice resulting from the alleged deficiencies of his counsel. And his claim of instructional error regarding the premeditated murder theory of first degree murder was not presented as a claim of ineffective assistance of counsel before the district court.
