Before the Court are Cross-Motions for Summary Judgment filed by Essex Insurance Company (“Essex”), Newton Agri-Systems, Inc., (“Newton”), and The Insurance House. Also before the Court is Newton’s Motion for a Separate Trial on Stanley Clayton’s Cross Claims. These Motions were referred to the Magistrate Judge, and, in his April 17, 1992, Report and Recommendation, (“Report and Recommendation”) the Magistrate Judge recommended that Essex’s Motion for Summary Judgment be granted as to all issues, that those of Newton and The Insurance House be denied, and that…
