The justices of the district court of appeal for the second district, before whom this appeal was originally pending, being unable to agree on a judgment therein, the matter has been transferred to this court for disposition. The defendant was prosecuted for murder, convicted of manslaughter, and sentenced to imprisonment in the state prison for a term of ten years. Upon the trial the killing by defendant was admitted, and he sought to justify it on the ground that it was done in necessary self-defense.
