On January 8, 1943, an involuntary petition in bankruptcy was filed against V. Loewer’s Gambrinus Brewery Company, Inc., the above-named debtor. On February 24, 1943, the alleged bankrupt filed a voluntary petition for reorganization under Chapter X of the Bankruptcy Act and the court made an order approving the petition for reorganization arid appointed John L. Flynn, trustee. The debtor had been engaged in the brewery business but its brewery was subject to a mortgage, which was under foreclosure.
