This matter comes before this court upon an appeal of a judgment rendered pursuant to a jury verdict finding the defendant, the appellant herein, guilty of second-degree murder. The trial was conducted in the Court of Common Pleas of Franklin County on an indict ment for first-degree murder, following a remand of such case from this court on July 30, 1974. The remand was based on the decision of this court that the trial court erred to the prejudice of the defendant in not permitting the introduction of the testimony of a witness offered by the defendant, such denial being on the basis that…
