Hawkins, Judge.
Relator was indicted in the District Court of Terry County, Texas, on September 15, 1936, charg-ed with felony theft. He was tried and judgment of conviction resulted on September 8, 1937, punishment being assessed at four years in the penitentiary. He invoked the jurisdiction of this court by prosecuting an appeal. The judgment of conviction was affirmed in an opinion delivered April 6, 1938. (See Moore v. State, 134 Tex. Cr. R. 542, 116 S. W. (2d) 720).
