I. INTRODUCTION

This action arises out of a motor vehicle accident resulting in fatal injuries to David H. Osenbach, Sr. Plaintiff filed a declaratory judgment action in the Berks County Court of Common Pleas, seeking a declaration that the Rejection of Underinsured Motorist Protection is void and that under-insured motorist coverage is available to Plaintiff under Defendant’s insurance policy.
