Being unable to agree with the conclusion reached by a majority of my brethren I respectfully dissent from the decision in this case. The great importance of the question involved calls for a rather full statement of my reasons.

Section 87, chapter 122, Session Laws of 1931 (the Motor Vehicle Act), provides in part: “The driver of a vehicle approaching an intersection shall yield the right of way to a vehicle which has entered the intersection. When two vehicles enter an intersection at the same time the driver of the vehicle on the left shall yield to the driver on the right.” Section 119(e)…
