MARTIN, Justice.
Appellee, Rosa McKinney, as plaintiff in the trial court, sued appellant, George W. McKinney, as defendant, alleging that a common law marriage existed between the parties and asked for dissolution of the same on the grounds of cruel treatment. The petition is in the usual form alleging that plaintiff has been an actual bona fide inhabitant of the State of Texas for a period of more than twelve months prior to exhibiting her petition and has resided in Deaf Smith County, Texas, where the suit is filed for a period of more .than six months next preceding the filing thereof.
