delivered the dissenting opinion.

Charles A. Gates, trustee of Shelby county, Tenn., and numerous other citizens, residents, taxpayers, and voters of Shelby county, filed the original bill herein for the primary purpose of having the “Unit Primary Bill,” chapter 2 of the Second Extraordinary Session of the Legislature of 1937, declared unconstitutional. All necessary parties were made defendants.

The defendants by their several demurrers insisted that the bill was valid.

The chancellor overruled the demurrers, but granted a discretionary appeal to this…
