BENAVIDES, Circuit Judge:

Petitioner Tommie Collins Hughes was convicted in Texas state court of capital murder and sentenced to death. Hughes filed a petition for a writ of habeas corpus in the United States District Court for the Northern District of Texas pursuant to 28 U.S.C. § 2254. The district court subsequently denied the petition. The district court also denied Petitioner a certificate of appealability (“COA”).
