Appeal from a judgment of the Monroe County Court (Patricia D. Marks, J.), rendered September 8, 2003. The judgment convicted defendant, upon her plea of guilty, of assault in the second degree.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.

Memorandum: Defendant appeals from a judgment convicting her upon a plea of guilty of assault in the second degree (Penal Law § 120.05 [2]). County Court imposed an enhanced sentence after defendant violated the conditions of her guilty plea by smoking marihuana and failing to appear for sentencing.…
