Appeal from a judgment of the superior court for Spokane county, Session's, J., entered May 20, 1914, upon findings in favor of the plaintiff, in an action on contract, tried to the court.

The purpose of this'action was to recover damages claimed to be due on account of the breach of a contract to convey real estate. The causé was tried to the court sitting without a jury. ■ A judgment was entered in favor of the plaintiff. The defendant appeals.

On the 4th day of June, 1912, and for some time prior thereto, the respondent was the owner of a farm consisting of approximately 2,000' acres, situated in Walla Walla county, state of Washington.'
