The pertinent facts with regard to plaintiff’s Motion for Leave to Amend filed August- 6, 1958, are as follows:

On September 24, 1952, Twentieth Century-Fox Film Corporation, organized under the laws of New York (hereinafter called “Fox-New York”), conveyed, pursuant to the decree in United States v. Paramount Pictures, Inc., D.C. S.D.N.Y.1949, 85 F.Supp. 881, its theatre interests to National Theatres, Inc., and all its remaining assets (including its production and distribution facilities) to Twentieth Century-Fox Film Corporation, organized under the laws of…
