This cause is before the court on Defendant’s Motion for Summary Judgment and Plaintiffs cross-motion for Summary Judgment. Both parties have fully briefed the issues and provided all relevant information. In addition, the court heard oral argument on July 25, 1997. This court now rules as follows.

JURISDICTION
