AMENDED FINDINGS OF FACT AND CONCLUSIONS OF LAW

SAYLOR, District Judge.

This is a dispute about the proceeds of a life insurance policy, arising under the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001, et seq.

The facts of this case are somewhat unusual. Darren and Doris Forcier were married in May 2000. Their marriage was both childless and unsuccessful; Doris filed for divorce less than two years later, in April 2002.
