This cause was submitted to the court below, on an agreed statement of facts, in substance as follows :

*65Catherine Roberts is, and for a long time has been, the wife of said Charles H. Roberts. Charles II. Roberts, at the time of the commencement of certain proceedings in bankruptcy hereinafter mentioned, was the owner of certain land described, situate in Greene county, Indiana. In May, 1878, said Charles II. Roberts filed his petition, in the District Court of the United States for the District of Indiana, sitting at Evansville, for the benefit of the bankrupt law of the United States; and…
