Appeal by the defendants, James E. McBride and others, from an order of the Supreme Court, made at the Bronx Special Term and entered in the office of the clerk of the county of Bronx on the 22d day of July, 1918, granting relator’s motion for a peremptory writ of mandamus.

In the month of August, 1917, the municipal civil service commission called for an examination open to all nurses in the health department who had served for a period of one year or more, for promotion to the position of supervising nurse. The examination was held on November 27, 1917. The commission on March 4, 1918, made up and promulgated an eligible list from the successful candidates of whom the relator was one and duly certified such list to the department of health.
