ORDER
FORRESTER, District Judge.
This matter is before the court on plaintiffs’ motion for summary judgment and motions for summary judgment by defendants Trust Company Bank and Trust Company Bank of Clayton County. Fed.R. Civ.P. 56. This action is brought under the Perishable Agricultural Commodities Act (PACA) statutory trust provisions, 7 U.S.C. § 499e(c). Plaintiffs are sellers and suppliers of perishable agricultural commodities who sold commodities to defendant B.H. Produce over a period of time but were never paid.
