This is an action to recover a commission for the sale of real estate. Plaintiffs recovered judgment and. *779the defendant appealed from the judgment and order denying his motion for a new trial. Appellant makes three assignments of error: 1. The action of the court in giving certain instructions; 2. The ruling of the court in refusing to give certain requested instructions; and 3. The insufficiency of the evidence to justify the verdict and judgment.
