On or about October 22, 1912, the appellant, Leadville Mining Company, who was defendant below, by its agreement gave an option to one Apollos Puller to purchase its property situate in the Turquoise mining district, Cochise county, Arizona, and the said Puller having paid to appellant on account of said option some $30,000, the appellee, as plaintiff, brought this action to recover compensation for his services in the matter. The plaintiff’s right to remuneration must necessarily arise by reason of a contract therefor, either express or implied. We must note with care this agreeement, if…
