MEMORANDUM AND ORDER
ROGERS, District Judge.
This matter is presently before the court upon plaintiffs motion to remand this case to the District Court of Shawnee County, Kansas. The court has heard oral argument on the motion and is. now prepared to rule. 1
Plaintiff Ron Todd, Insurance Commissioner for the State of Kansas, brought this action in his capacity as statutory liquidator for National Colonial Insurance Company (NCIC) in the District Court of Shawnee County, Kansas.
