The plaintiff in error, Richard Warren Silva, brings writ of error here from a conviction of the crime of felonious escape. He will be referred to as the defendant, or by name.
The evidence showed that on September 11, 1961, Silva was sentenced on two separate convictions of burglary, the court imposing a sentence in the state penitentiary of three to five years on one conviction, and of two to five years on the other.
