TIPTON, Judge.
In the circuit court of the city of St. Louis, the appellant was convicted of forcible rape and his punishment was assessed at twenty-five years’ imprisonment in the penitentiary. From that judgment and sentence he has duly appealed.
The evidence on behalf of the state shows that at about 7:45 p. m. of Sunday, July 26, 1953, the prosecutrix, Nancy Pax-ton, 68 years old, went into a tavern called the Little Gam located at 3673 South Broadway in the city of St. Louis, and ordered a beer.
