The Pennsylvania Department of Transportation (Penn-DOT) appeals the April 4, 1991 order of the Court of Common *339Pleas of Philadelphia County (trial court) which dismissed PennDOT’s preliminary objections to the petition for appointment of viewers filed by Appellees George Mano, Sr. and George Mano, Jr. (Landowners).
