This action was commenced in the district court of Atoka county, Okla., on the 23d day of April, 1910, by the city of Lehigh, hereinafter designated as plaintiff, against the O’Neil Engineering Company and the Southern Surety Company, hereinafter designated as defendants. It is claimed by the plaintiff that on the 25th day of July, A.
