This was an action to foreclose a mortgage on real estate, and a cross action to recover on a policy of fire insurance, the details of which will require to be stated at some length.

The defendant, Frank A. Johnson, was the owner of several valuable farms in Republic county. Three of these farms were separately mortgaged to the Mutual Benefit Life Insurance Company for the amounts of $9,500, $8,000 and $12,000, respectively.
