MEMORANDUM OPINION AND ORDER 1

SHADUR, District Judge.

Magnus Electronics, Inc. (“Magnus”) has sued the Argentine Republic (“Argentina”) for damages for converting Magnus’ goods. Argentina has now moved under Fed.R.Civ.P. (“Rule”) 12(b)(1) to dismiss Magnus’ Complaint 2 for lack of subject matter jurisdiction. 3 Argentina also seeks reimbursement of its expenses under Rule 11. For the reasons stated in this memorandum opinion and order, the first motion is granted, while the second is granted in part and deferred in part.
