This is an action for damages instituted- by Lawrence Scarbrough against William M. Burge and the National Surety Company. The court submitted the cause to the jury under three counts lettered A, B, and C, with plea thereto by each defendant of general issue in' short by consent with leave to give in evidence any matter that would be a legal defense, and with leave of plaintiff to give in evidence any matter that would be good in legal reply thereto.
