Ritz, Judge:
The defendant in this case is a merchant at North Fork, West Virginia. Plaintiff had been dealing with him in small amounts over a period of about three years. On the occasion of the transaction out of which this litigation arose, according to the contention of the defendant, the plaintiff came to his store and gave an order to one of his salesmen for a very much larger amount of goods than he had ever bought before.
