MEMORANDUM OPINION

ELLIS, District Judge.

This diversity motor vehicle accident case raises the issue, unresolved in Virginia, whether the “fireman’s rule” operates to bar recovery by a policeman when he is injured by the negligence of a person unrelated to risk to which he was responding. Plaintiff, a police officer, alleges he was injured when defendant’s negligently operated vehicle caused him to lose control of his motorcycle.
