GORTON, District Judge.

This habeas petition arises out of a first degree murder conviction returned on November 24, 1997 in Massachusetts Superi- or Court.

I. Background

Petitioner Timothy Duguay (“Duguay”) was convicted of stabbing to death his neighbor, Robert Madera (“Madera”). He is currently serving a life sentence. Duguay has since adamantly pursued relief from that conviction. The Massachusetts Supreme Judicial Court (“the SJC”) affirmed the judgment entered against him in December, 1999.
