WEXLER, District Judge.

Gilbert Carroll (“Carroll” or the “Petitioner”) seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254. For the reasons that follow, the application is denied.

I. Background

In an indictment handed down by a Suffolk County grand jury petitioner was charged with the commission of several sexually-related offenses alleged to have occurred on April 4 or April 5 of 1983.
