I. INTRODUCTION
This matter is before the Court on Defendant Arlington Capital, LLC’s motion to compel Plaintiff R. David Boyer, Trustee (“Trustee”), to produce five e-mail communications that he has withheld under the claim of work product doctrine or common interest doctrine. (Docket # 184.) The withheld emails are responsive to a request for production served by Arlington Capital on the Trustee on May 22, 2008. (See Docket # 148.)
